In the early morning hours of Nov. 24, the car that a woman and her young nephew were in broke down. The two exited the vehicle and walked along the shoulder of the Louisiana Interstate 10. As they were ascending a bridge on the west side of the Interstate, a pickup truck slammed into the back of another vehicle. That initial car wreck began a chain reaction that ultimately ended with the two pedestrians being struck.
The impact sent the two over the edge of the bridge to the ground below. No one is sure just how far the woman and her nephew fell, but the impact was enough to kill the woman at the scene. Her nephew survived the fall and was taken to a Louisiana hospital. Unfortunately, he later succumbed to his injuries. Other people involved in the chain reaction accident suffered non-life threatening injuries, but their current conditions are not known.
The driver of the pickup truck fled the scene before police arrived. Reports indicate that he did not realize that anyone was fatally injured because of the accident. Authorities have charged the driver of the pickup truck with hit-and-run and manslaughter. He was still in custody at last report, and his bail has been set at $210,000.
The family of the victims did not wish to comment on the situation. They are undoubtedly grieving for the sudden loss of not only one, but two of their family members. The little boy who died was just a 2-year-old, and his family will never get to see him grow up. Successfully navigated wrongful death claims against the party or parties responsible for this tragic car wreck may give the family some justice on behalf of the loved ones they lost, in addition to any financial redress a civil court may award for the damages incurred by the family.

Car Wreck on Louisiana Hwy 2 Kills 1, Injures 2
The Louisiana State Police reminded drivers to stay attentive while driving in the aftermath of a recent accident. Troopers warn drivers that being impaired, fatigued, driving too fast and being distracted by things such as electronic devices can cause a car wreck. Troopers have not yet determined what factors may have caused a driver in this recent wreck to veer off course. However, they do not believe alcohol was a factor, though toxicology samples were obtained nevertheless.
A portion of Louisiana Highway 2 was closed as troopers conducted a preliminary investigation of the head-on collision that occurred on Nov. 19. From the information gathered at the scene, police have surmised that the eastbound vehicle strayed into oncoming traffic directly into the path of a westbound vehicle. The crash caused fatal injuries to the eastbound driver, and emergency responders pronounced him dead at the scene.
Two people occupied the other vehicle. The 62-year-old driver suffered injuries that were described as moderate and was taken to an area hospital. His 34-year-old passenger’s injuries were more serious, and she was taken to the same hospital. Their current conditions are not known.
Depending on the extent and nature of the injuries they sustained, a long recovery could be ahead. As a result of this car wreck, they have likely been incurring expenses for medical treatments and may have lost income from missed time at work as well. Both have the right to pursue personal injury claims against the estate of the deceased driver in the hopes of recovering the damages incurred, plus pain and suffering and any other damages applicable under our laws.
Driver's Estate Could Be Held Liable in Louisiana Car Wreck
Anytime passengers get into a car, they are entrusting their lives to the driver. There is an unspoken trust that the driver won’t be the cause of a car wreck. For some passengers, that trust is misplaced if a driver is speeding or is impaired when he or she gets behind the wheel of the car. As a result, thousands of passengers nationwide and in Louisiana are injured or killed each year.
On Oct. 12, a passenger was seriously injured in a single car accident. The driver somehow lost control of the vehicle, causing it to fly into a fence and utility pole. The passenger had to be taken to an area hospital with unknown injuries. The only information regarding the passenger’s condition at the time of the accident is that the injuries were serious, but there is no information on her current condition.
The driver sustained severe injuries in the crash and did not survive. Police believe that the man, who had recently relocated to Louisiana from Florida, may have been speeding and impaired. Luckily, there were no other vehicles involved in the accident.
The passenger may be facing a lengthy recovery process, depending on the nature of the injuries she sustained in the car wreck. Medical bills, lost wages and pain and suffering can all be part of the aftermath of such a tragedy. Successfully litigating a claim against the estate of the driver may give the passenger the monetary reimbursement she needs in order to recoup the financial losses she is incurring and may incur in the future.
Man Sues Louisiana Dillard's for Car Wreck
Back on Aug. 12 of last year, a man was sitting in his car at a Dillard’s in Louisiana. Without ever leaving his parked car, the man became the victim of a car wreck. He is now suing several people including Dillard’s since the driver that hit him was in a vehicle owned by Dillard’s.
The driver that hit him was leaving the parking lot when he struck the occupied parked her. It is alleged that the driver had been speeding. He has since been charged with careless driving, speeding, failing to control his vehicle, among other things. The nature and extent of the parked man’s injuries was not detailed. It is also not known if the speeding driver was injured or not.
The suit was filed against not only Dillard Department Store Inc., but also against Discovery Insurance Company, Allstate Property and Casualty Insurance, Higbee Lancoms, LP and the driver of the vehicle. The vehicle was owned by the popular department store and insured by Discovery Insurance Company. Since the driver was operating a company vehicle at the time of the accident, the plaintiff believes the corporate entities should be found at least partially responsible for the accident.
There is a concept in law known as vicarious liability. When a company employee has a car wreck in the course of their employment or in a company vehicle, it is possible that the employer may be held liable for the actions of the driver of that vehicle. If this Louisiana man’s lawsuit is successful, he may be awarded financial compensation for damages such as pain and suffering, rental expenses, lost wages, permanent disability, loss of consortium, among others.
Louisiana State Police Investigate Car Wreck on LA 3132
The Louisiana State Police are still investigating a crash that recently took place on La. 3132. One person died as a result of the car wreck. The other driver has not yet been charged pending the outcome of the official investigation.
A vehicle was traveling eastbound on La. 3132 when the driver of that vehicle lost control. The vehicle careened through the median and rolled over into the westbound lanes. A vehicle traveling on the west side of the highway was struck by the vehicle. The driver of that vehicle was thrown from her car during the impact.
The woman that was thrown from her vehicle sustained fatal injuries and was pronounced dead by authorities at the scene. The woman that lost control of her vehicle sustained injuries that were not considered life threatening. She provided the Louisiana State Police with a toxicology sample and was taken in to talk to investigators about the accident. The screening was said to be routine, but depending on the results of the test, it could affect any charges that may be filed against the driver.
As the investigation progresses, the family of the deceased victim may be struggling to deal with her sudden death. The victim was only 37 years old when she died. Any family members that may be left behind retain the right to file a wrongful death claim against the driver of the other vehicle regardless of the criminal charges that may be filed. The money won’t bring their loved one back to them, but it could help with the unexpected expenses the family has encountered since the car wreck.
Man Killed, 3 Injured in Car Wreck in Louisiana
The Louisiana State Police believes that alcohol played a factor in the death of one man and the injury of three children recently. The man driving the vehicle at the time of the car wreck sustained injuries as well. So far, no charges have been filed in connection with the crash, but police say they are pending.
The driver was driving on La. 39 when for an as yet unknown reason he left the road. The vehicle went into a ditch, flipped and slammed into the side of a house. In the car with the driver was the front seat passenger who was thrown from the car during the accident. In the backseat were three young children.
The driver and the three children all sustained moderate injuries and were taken to the hospital to be treated for their injuries. The current condition of these four is unknown. The front seat passenger was pronounced dead at the scene. Police are awaiting the results of a toxicology test taken as part of the investigation. It is presumed that the Louisiana State Police are awaiting the results of this test before deciding what charges should be filed against the driver, if any.
As the investigation continues, the family of the front seat passenger and the families of the children may have a long road of healing ahead of them. Hopefully, the children will not be permanently injured as a result of the accident. However, there is no guarantee. The families may be facing further medical care in the future. Under Louisiana law, the family of the deceased man has the right to file a wrongful death claim and the family or families of the children have the right to file personal injury claims in connection with this car wreck to receive some financial relief for the unexpected expenses they are incurring.
