Man who survives mutli-auto accident is then struck and killed

Anyone here in Louisiana who has ever been involved in a crash knows that in the minutes following a car accident, the scene is often in chaos. Those moments are also the most dangerous for those involved. As the people involved in a multi-auto accident assess their injuries and the damage to their vehicles, approaching vehicles could strike the vehicles and/or the people.
On a recent Sunday at approximately 4:50 a.m., four vehicles were traveling westbound on Interstate 10. The driver of one of them lost control, which sent the vehicle into a guardrail. It then bounced off the guardrail and back into the lane of travel at which point it was hit by a second vehicle. A third vehicle then struck the second one.
When all three vehicles had come to a rest, the driver of the second vehicle exited his car. A fourth vehicle came along at that time and struck that driver. The impact caused him to suffer fatal injuries to which he succumbed at the scene. A passenger that was in one of the vehicles suffered severe injuries, and, at last report, remained hospitalized in critical condition. So far, officials have not filed any charges in connection with this tragedy.
The family of the deceased victim retains the right to file a wrongful death claim against the party or parties believed to be responsible for his death. The critically injured victim may have the right to file a personal injury claim in connection with this auto accident as well. In both claims, it will be necessary to establish that the injuries received — whether severe or fatal, as applicable — were due to the negligent actions of one or more parties. If successful, a Louisiana court could enter an award of damages.
